Acceptance of Terms
By accessing this website or engaging Pascual Creative ("we," "us," "our") for design, marketing, or media services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.
Services
We provide branding, web design, digital marketing, and media production services for real estate professionals. The specific scope, deliverables, and pricing for any project will be outlined in a separate proposal or agreement.
Quotes and Pricing
All quotes are valid for 30 days from the date issued unless otherwise stated. Pricing is subject to change based on project scope, revisions, and additional requests beyond the original brief.
Payment Terms
Unless otherwise agreed in writing, a deposit is required to begin work, with the balance due upon project completion. Late payments may incur additional fees. All prices are in Canadian dollars and do not include applicable taxes.
Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, and necessary assets such as logos, images, and brand guidelines. Delays in providing these may affect project timelines.
Intellectual Property
Upon full payment, ownership of final deliverables transfers to the client for the agreed use. We retain the right to display completed work in our portfolio unless otherwise agreed in writing. Third-party assets used in projects are licensed under their respective terms.
Revisions and Approvals
Each project includes a defined number of revision rounds as outlined in the proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Final approval of deliverables is the client's responsibility.
Project Timeline
Estimated timelines are provided in good faith and depend on timely client input. We are not liable for delays caused by circumstances beyond our control, including late feedback or changes to the project scope.
Confidentiality
We treat all client information as confidential and will not disclose it to third parties without consent, except as required by law or as necessary to deliver the agreed services.
Limitation of Liability
To the fullest extent permitted by law, our liability is limited to the fees paid for the specific services giving rise to a claim. We are not liable for indirect, incidental, or consequential damages.
Termination
Either party may terminate a project with written notice. Fees for work completed up to the termination date remain payable. Deposits are non-refundable once work has commenced.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario.
Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms.
